Ember Terms & Conditions
1. Introduction and acceptance of these terms
These Terms & Conditions ("Terms") govern your access to and use of Ember (the "Service"), provided by [LEGAL BUSINESS NAME] ("Ember", "we", "us"). By creating an account, logging in, or otherwise using the Service, you agree to be bound by these Terms and our Acceptable Use Policy and Privacy Policy, which are incorporated by reference.
If you do not agree to these Terms, you must not use the Service.
2. Eligibility and age requirement
You must be at least 18 years old to create an account or use Ember. By registering, you confirm that you are 18 or older and that you are legally able to enter into binding agreements. Users who are under 18, or who misrepresent their age, are not permitted to use the Service and will be removed.
You may only create one account and must use your real identity. Sharing, transferring, or selling your account is not permitted.
3. Age verification and age assurance
Ember uses age-assurance measures to help prevent underage use. When you register, you are required to provide your date of birth and confirm that you are 18 or older. Accounts whose provided date of birth indicates the user is under 18 are blocked from registration.
As part of onboarding, Ember may estimate your age from a verification selfie using automated analysis and may, where appropriate, require additional verification using a government-issued identity document. Profiles that are flagged by these checks as potentially underage are held for review and may not interact with other users until the review is complete.
Ember reserves the right to request additional age verification at any time where an account is suspected to be operated by a minor. Failure to complete requested verification may result in account suspension.
4. Your account
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate and complete information during registration and to keep it up to date.
Ember verifies new accounts by email. You must use a valid email address that you control.
5. User content
You are responsible for the photos, text, prompts, messages, and any other content you post or send through Ember. You must own or have the right to share it, and it must not infringe the rights of any third party. You grant Ember a licence to host, display, and process your content for the purpose of operating the Service.
Ember may remove content that violates these Terms or our Acceptable Use Policy, and may do so without prior notice.
6. Prohibited uses
Your use of Ember is subject to our Acceptable Use Policy, which describes prohibited conduct including harassment, impersonation, trafficking, sexual content, non-consensual behaviour, and illegal activity. Violations may result in content removal, account restriction, suspension, or permanent termination.
7. Fees and subscriptions
Ember offers optional paid subscriptions ("Ember Premium"). Fees are billed in advance on a recurring basis until you cancel. You can cancel at any time; cancellation stops future renewals but does not refund the current period. Prices and features are shown in the app at the time of purchase.
Payments are processed by our payment provider. Refunds, where applicable, are governed by the terms of the payment provider and applicable law.
8. Intellectual property
Ember, including its name, logo, design, and software, is owned by [LEGAL BUSINESS NAME] and protected by intellectual property laws. You may not copy, modify, or distribute Ember's branding or software without permission.
9. Account suspension and termination
Ember may restrict, suspend, or terminate your account at any time if you violate these Terms or the Acceptable Use Policy, or to protect the safety or integrity of the Service. Enforcement actions include warnings, functional restrictions, temporary suspensions, and permanent bans.
You may delete your account at any time from the app's settings. Suspended or banned users may not create a new account.
10. Takedown procedures
When a report is submitted, Ember creates a moderation case, assigns a priority level, and routes it to the moderation queue. High-risk reports involving suspected minors, trafficking, sexual content, or threats are prioritised. A moderator reviews the case and may remove content, warn the user, restrict, suspend, or permanently ban the account. The decision and the reason for it are recorded. Where appropriate, the affected user is notified and may appeal.
11. Appeals
Users whose content has been removed or whose account has been restricted, suspended, or banned may submit an appeal. Appeals can be submitted through the in-app appeal process or through Ember's support channel. An appeal is reviewed by a member of the moderation team who was not responsible for the original decision where reasonably practicable. If the appeal is upheld, the content or account may be restored. If denied, the enforcement action remains in place.

12. Law enforcement cooperation
Ember cooperates with valid legal requests from law enforcement and government authorities. Our protocols for receiving, reviewing, and responding to such requests are described in our Law Enforcement & Safety Protocols.
13. Preservation and disclosure of information
Ember retains account and usage data only as long as necessary to provide the Service and meet legal obligations. In response to valid legal process, Ember may preserve and disclose account information, content, and usage records as required by law. Where permitted, Ember notifies users of requests for their data.
14. Disclaimers and limitation of liability
The Service is provided "as is" and without warranties of any kind. Ember does not guarantee that every user is who they claim to be or that all prohibited content will be prevented from appearing. To the maximum extent permitted by law, Ember is not liable for indirect, incidental, or consequential damages arising from your use of the Service.
15. Changes to these terms
We may update these Terms from time to time. We will notify you of material changes through the app. Continued use after changes take effect means you accept the updated Terms.
